General Conditions of sweetsaltbrand.com
1. General note
The sweetsaltbrand.com website is part of the clothing brand sweetsalt; any further reference to the brand or the business in general in these conditions, will be stated under the term sweetsalt. These General Conditions (later referred to as “GC”) of sweetsalt apply to all products and services (below referred to as “product/s”) offered by sweetsalt as part of its activities on the website sweetsaltbrand.com as well as to pages of destination (landing pages) associated. The term “customer” refers to any natural or legal person entering a business relationship on sweetsalt or registering a user account on sweetsalt.
Unless otherwise specified by sweetsalt for a given product, these GC apply to all products offered on sweetsaltbrand.com as well as to the landing pages. Any commercial transaction between sweetsalt and the customer takes place exclusively on the basis of these GC. sweetsalt may modify these terms and conditions at any time and without notice. At the time of publication of modified GC, these come into effect immediately and replace any previous version of the GC, valid until then.
All information (descriptions, product images, measures, weight, etc.) and prices are non-binding and subject to change. Technical changes are expressly reserved.
sweetsalt assumes no liability for information regarding product information, and availability. It is our concern to present and update this information in the best possible way.
The customer understands that delivery delays may occur in the event of delivery bottlenecks or inaccurate inventory data. sweetsalt endeavors to avoid these situations and to reproduce the data as correctly as possible.
The entirety of the information on availability and delivery times is therefore non-binding and without guarantee and may change at any time without notice. A delivery may also be canceled if the product can no longer be manufactured or delivered. In this case, a delivery impossibility occurs and the provisions of point 6 of these Terms apply.
Unless otherwise stated, all prices indicated on sweetsalt are to be considered VAT (or any other government tax) excluded.
The price of the product indicated on sweetsalt at the time of the order is binding. However, sweetsalt reserves the right to retroactively adjust the price, in case there is an error on the price at the time of the order, for technical reasons or for other reasons.
The shipping costs are, unless otherwise stated, to be borne by the customer and may vary depending on the customer’s country of residence, the order quantity and order value.
The data requested at the time of the customer registration on sweetsalt must be specified truthfully and comprehensively. Each customer is responsible for the recorded information and their updating. sweetsalt assumes no responsibility whatsoever regarding the content and information provided by the customer. In addition, the customer must ensure that his access data is not made available to unauthorized third parties. Registration is reserved exclusively for those who have the capacity to act. The customer declares not to be under guardianship and to enjoy the faculty of discernment.
There is no claim right on the data recorded or published by the customer (e.g. in the case of a personal assessment or a review on sweetsalt). sweetsalt has the right to delete or edit content.
Each customer has the right to open and use a single user account. It is prohibited to open and manage more than 1 (one) account per customer. sweetsalt reserves the right not to accept a registration, to warn or unsubscribe for failure to comply with the following GC.
6. Conclusion of the contract
By clicking the confirmation button on one of the available payment methods (last step in the checkout process) the customer is committed to sweetsalt for the order made. The contract is concluded at the time of acceptance of the order by sweetsalt or at the latest at the time of release and delivery of the ordered product. The customer receives an order confirmation by e-mail automatically generated. sweetsalt reserves the right not to accept an order without motivating its reason.
A confirmation is not an assurance that the product is effectively available and can be delivered; this is subject to the terminating conditions set out in point 3. sweetsalt has the right to refuse an order without giving reasons.
If a product can not be delivered due to the conditions mentioned in point 3 of these GC, the customer will be informed and offered a replacement solution. If the customer refuses the replacement solution within 5 days of his offer, he must inform sweetsalt in writing (or by e-mail) and there will be a cancellation in accordance with point 12 of these terms and conditions. If the substitute solution is not rejected by the customer in writing (or by e-mail) within the specified period, the contract will remain in place and sweetsalt will provide the customer with the substitute solution which he is obliged to accept.
7. Terms of payment
The customer undertakes to use only the payment methods proposed on sweetsalt. Where it is not specified otherwise, the additional costs of processing the payment are borne by the customer.
8. Retention of ownership
The ownership of a product is granted to the customer only after full payment of the selling price. Up to that time the product remains the property of sweetsalt.
sweetsalt is not liable for the shipping or the correct delivery of the ordered products. We are not responsible for the delivery of the goods if they have to be left in an unattended place (e.g. because the customer could not accept them immediately). In some cases, depending on the specific carrier in the customer’s country, the package can be delivered to the local post office for pick-up if the customer isn’t able to collect the package immediately from the courrier. PO BOX addresses are not eligible for shipping, please provide a residential or business address and a valid phone number for the shipment. We are not liable for damaged, stolen or lost products.
All fee or taxes related to customs and duties for the importation of the ordered products in his country, are paid by the customer (usually at the moment of the delivery of the order). It is the customer’s responsibility to be familiar with the import regulations and fees that applies to his country.
Orders cannot be re-routed once they are sent out. We kindly invite the customer to double-check the delivery address. Any unclaimed order will be sent back to us and the customer will be responsible to pay for re-delivery back to us, as well as for every incurred customs taxes, fees or additional cost.
sweetsalt is not liable for transport damage or negligence of third parties. In the event of damage in transit, the customer must inform sweetsalt and the carrier in writing (or by e-mail) immediately after receipt of the goods. All deliveries are made on the responsibility of the customer unless he can transfer those risks to the transport company.
The customer is obliged to inspect the goods immediately upon receipt and to report wrong deliveries or defective products to sweetsalt within 48 hours. Furthermore, the provisions in point 12 of these GC apply.
sweetsalt has the right for certain products to use a quantity restriction for deliveries and without stating reasons.
The customer is obliged to verify that the reception of communications in electronic form by sweetsalt is possible. In particular, the customer is responsible for ensuring that the specified email address is valid and that the space available in the mailbox is sufficient. sweetsalt is not responsible if an e-mail should be filtered as spam; the customer is obliged to ascertain this and if this should be the case, mark the sender as “reliable”. An e-mail filtered in spam, in particular a confirmation of order or the sending of a product, are considered valid. sweetsalt is responsible for sending the e-mail, but assumes no responsibility for the classification or delivery in the customer’s mailbox, as this depends on the customer’s data and settings.
The customer acknowledges that due to technical or other unpredictable problems, there may be a delay in delivering a product. Delivery times are not binding and delivery delays are under no circumstances a justification for the customer’s withdrawal from the contract or for claims for compensations or damages of any kind.

10. Return and replacement policy
Basically for all products offered by sweetsalt there is no right to return or a replacement claim from the customer. The right of withdrawal or reduction of the price is excluded. The customer will be entitled to a spare only in case of defects attributable to sweetsalt. Only manufacturing defects or defective products are considered for replacement. The customer must inform sweetsalt in writing (or by e-mail) and enclose valid evidence to demonstrate what is reported. The replacement right applies only to products with a defect attributable to sweetsalt.
Returns must first be reported by the customer to sweetsalt and the customer must have a written (or by e-mail) consent before returning the product at his own risk and expenses in the original packaging. Only returns in the original packaging will be accepted.
If no defect is reported to sweetsalt within 48 hours after delivery of the product, the latter is considered of impeccable quality and condition and accepted by the customer.
sweetsalt excludes completely the right of compensation or termination of contract for breach of contract, impossibility of performance, indebtedness at the time of conclusion of the contract, or in the event of inability to act (except in case of serious negligence or deliberate action). Any liability for direct, indirect or consequential damages and of any nature arising out of the use, misuse or failure of the performance is expressly excluded.
The customer also recognizes that he can get all the important information about a product before buying it on sweetsalt.
The access and use of sweetsaltbrand.com are not guaranteed. sweetsalt uses every resource and a means at its disposal to ensure the availability and performance of the sweetsaltbrand.com website. The customer understands and accepts that it cannot be guaranteed to operate or be available without interruption. In the event of a malfunction or unavailability of the system or part of it, sweetsalt cannot be held responsible and any right to compensation, termination of the contract or right to the lesser value is excluded.
In the case of links that lead from sweetsalt to third party sites and which are therefore not managed by sweetsalt, the latter is not responsible for the content published on these sites.
Orders on sweetsaltbrand.com are binding according to point 6 and the customer is obliged to accept them. Cancellations are generally not possible, but are approved by sweetsalt in certain cases. The customer agrees that in the event of an authorized cancellation, administrative costs of 25% of the ordered value, but at least USD 30.00 (or the equivalent amount in the customer’s order currency) plus postage fees incurred and loss of value of goods since the time of the order, will be charged.
If an order is not accepted by the customer after 7 days after the delivery date, sweetsalt has the right to terminate the contract and to invoice the aforementioned administrative costs. The amounts, which were transferred by the customer to sweetsalt, are credited to the original account less the above-mentioned administrative costs.
In the event of cancellation due to a delivery impossibility (in reference to point 6 of these GC), the paid amounts will be refunded to the customer.
13. Data protection, security and confidentiality
The information necessary for the performance of the service is collected and processed by sweetsalt. In order to ensure the regular performance of the service, such information may be communicated to third parties (e.g. a shipping company). All personal information is treated confidentially.
The customer has the option to modify his personal information on his or her user account at any time.
sweetsalt implements the security measures reasonably imposed by the circumstances and proportionate against unauthorized access, use, transmission, alteration, loss or destruction of personal data. These measures include technical measures (the transmission of data on sweetsalt is encrypted through a TSL certificate), physical and organizational. The sweetsalt system is based exclusively on servers based in Switzerland and which include state-of-the-art security measures.
Internet is an open network and easily accessible to everyone, it is therefore not considered as safe environment. Therefore, sweetsalt cannot guarantee, nor guarantee, an absolute level of security.
14. Jurisdiction and applicable law
The exclusive competent forum for all quarrels with sweetsalt is Bellinzona. sweetsalt reserves the right to sue the customer at the jurisdiction of his domicile. Swiss law is exclusively applicable.
15. Intellectual property
The present GC as well as all the images and all the texts on sweetsaltbrand.com as well as the related landing pages are protected by copyright and property of sweetsalt. sweetsalt reserves all rights exclusively. A use of any kind, even in part, as well as in modified form, is absolutely prohibited, unless expressly permitted in advance and in writing by sweetsalt.
No right of any kind is acquired, either by accessing, downloading, copying or transferring pages or other content on sweetsalt.
Transgressors will be prosecuted legally.
16. Salvatory clause
In the event of a partial nullity of the contract or the present GC, as well as any unforeseen omissions in the contract or in these GCs, the customer undertakes to respect the valid part. sweetsalt reserves the right to declare the entire contract void.
